AUSTRALIAN VISA TYPES

SKILLED MIGRATION VISAS

Skilled workers and business people interested in migrating to Australia can opt for a Skilled visa by submitting an Expression of Interest (EOI) usingthe SkillSelect service. An EOI is an indication that the applicant would be interestedin obtaining a Skilled visa.

Important: An EOI is not a visa application.

Note: SkillSelect is an online service that helps Australia manage its skilled migration programme based on its economic requirements. It supports the government in managing who can apply for skilled migration, when they can apply and in what numbers. As a result, the time taken to process a visa application is significantly reduced.

SkillSelect also helps in addressing regional skill shortages. SkillSelect allows intending migrants to indicate if they are willing to live and work in regional Australia. This especially benefits employers experiencing regional skill shortages and state and territory governments attempting to settle migrants in regional Australia.

The Skilled Migration Visas includes the following sub-classes:

SUBCLASS 189 SKILLED INDEPENDENT VISA

To apply for this visa, the applicant should work in a job on the Medium and Long-term Strategic Skills List (MLTSSL) and be able to meet the skill assessment requirements for your occupation. Eligibility for the 189 visa is based on a point score, taking into account age, qualifications, work experience and English competence.

In order to work in a role on this list, the applicant does not require sponsorship from a relative or state, and can live in any part of the country.

SUBCLASS 190 SKILLED NOMINATED VISA

This is one of the most well-known visa processes. It includes a points-based application system, which analyses what you have to offer to Australia once you move here.

The applicant needs to consider the following option while applying for 190 visa:

  Work in a profession that is listed as in shortage

  Reach the standard necessary for points-based applications. This will be based on age, english competence, training and work experience.

  Sponsored by a state or territory.

SUBCLASS 489 SKILLED NOMINATED OR SPONSORED VISA

Like all skilled visas, the Skilled – Nominated or Sponsored (489) visa is a points-based application.

There are two pathways for the 489 visa:

  State Sponsorship on a 489 Visa: The Skilled Sponsored (489) visa requires sponsorship by an Australian state or territory. Each state has unique skill shortages and thus occupations appear at different times on different lists. Each state varies in its specific requirements. Some states require applicants to have higher English scores, while others require more work experience or detailed evidence of the applicant’s assets.

  Relative Sponsorship on a 489 Visa: If the nominated occupation of the applicant is on the Medium and Long-term Strategic Skills List (MLTSSL), then the applicant can be sponsored by an eligible relative living in a designated area. Your relative must be a permanent resident or citizen of Australia. This includes your sibling, parent, child, aunt, uncle, cousin or grandparent. You must live in the same designated area as your relative.

STUDENT VISA – SUBCLASS 500

Australia is a great place to study and the country offers a diverse range of study options for international students. Once you have been accepted into an Australian course, the next step is to organise the student visa.

As an international student on a student visa, you must study with an institution and in a course that is registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS). CRICOS registration guarantees that the course and the institution at which you study meet the high standards expected by international students.

This visa allows you to stay in Australia to study full-time in a recognised education institution. It allows you to study and work in Australia throughout the duration of your course. You are entitled to work 40 hours per fortnight during your studies, and full-time during your schools breaks.

As a guide, the key requirements you will need to meet are:
Electronic Confirmation of Enrolment (eCoE) certificate
Meet the Genuine Temporary Entrant requirement
Sufficient funds for airfares, course fees and living costs
English language proficiency
Meet health and character requirements
Acceptable Overseas Student Health Cover

MARRIAGE AND PARTNER VISAS

The Australia Partner Migration Program is open to married and de-facto couples in sustaining a genuine relationship with an Australian Citizen or a Permanent Resident. This visa allows you to travel to Australia with your partner.

If you have been in a genuine relationship for three years or more, you may be granted a permanent resident visa. If not, you may be granted a temporary visa and after two years of ongoing relationship, you will be eligible to apply for permanent residency.

You can start a new chapter of your story together with a temporary to permanent residency visa for you and your partner.

TOURIST\VISIT VISAS

This visa allows you to visit and stay in Australia for a temporary period for reasons such as holidays, sightseeing, social or recreational reasons, to visit relatives, friends, to be a business visitor or for other short-term non-work related purposes,such as medical treatment or medical consultations.

There are various types of visas available for visiting Australia. The type of visa that you may be able to get depends on a number of factors such as, the length of your stay, your passport, your current location and the purpose of your visit.

This visa is grantedby the Australian government on a case-by-case basis:

  Visitor visas of up to five years validity provides a stay of up to 12 months on each entry to those parents who are outside Australia and are in the Parent (subclass 103) visa queue.

  Visitor visas of up to three years validity with 12 months stay on each entry is considered for parents who are outside Australia and are not in the Parent visa queue.

Note : A condition is placed on these visas that restricts the time that can be spent in Australia to 12 months in every 18 months.

OTHER WORK VISAS

SUBCLASS 485 TEMPORARY GRADUATE VISAS

The applicant is eligible for this visa in either the Graduate Work stream or the Post-Study Work stream if the applicant holds a student visa and has recently completed or soon to complete the course of study.

  Graduate Work stream: For international students with an eligible qualification that relate to an occupation on the list of eligible skilled occupations. A visa in this stream is granted for 18 months from the date of grant.

  Post Study Work stream: For international students who graduate with a higher education degree from an Australian education provider, regardless of their field of study. A visa in this stream can be granted for up to four years from the date the visa is granted, depending on the visa applicant’s qualification.

The 485 visa can be offered from 18 months to four years, depending on the stream and on your completed course. The 485 visa does not require sponsorship from an employer, a relative or a state or territory of Australia. The 485 visa is not points-tested and you have unlimited work rights.

It is very important that the correct stream is chosen as you cannot change the stream after application.

 

SUBCLASS 476 GRADUATE VISA

A recent university engineering graduate can be eligible for the Skilled – Recognised Graduate Visa.

This 18-month visa is ideal for engineering graduates who want to experience life in Australia. This gives the applicants full work rights and can choose their own employer.

PARENT VISAS

The Parent visa allows the parents live permanently in Australia if they have a child who is an Australian citizen or a permanent resident who is settled in Australia.​

This is a permanent residence visa which allows the parents of the Australian citizen or permanent resident to:

   Stay in Australia indefinitely

   Work and study in Australia

  Enroll in Medicare, Australia’s scheme for health-related care and expenses

  Apply for Australian citizenship (if you are eligible)

   Sponsor eligible relatives for permanent residence

   Travel to and from Australia for five years from the date the visa is granted (after that time, you will need a resident return visa or another visa to return to Australia).

The Parent Visa is further categorized into the following types:

Parent Visa (Subclass 143 Or 173) – An offshore application: If the parents are aged under 65 years and meet the balance of family test (50% of the parents’ children are settled in Australia as permanent residents or citizens), they can lodge a contributory parent visa, but must be outside Australia to do so.

Aged Parents – Onshore Application – Two Options:If one of the parents is aged 65 years or over, and they enter Australia on a visa that allows them to lodge a parent visa onshoreand the balance of family test is met, the parents can lodge an application whilst in Australia.

Aged Parent Visa (Subclass 804):This non-contributory aged parent visa has an extremely long processing time (over 25 years), but the parents can live in Australia until a decision is made.

Contributory Aged Parent Visa (Subclass 864):Parents aged over 65 can lodge a contributory parent visa whilst onshore on a valid visa. This Parent visa involves making a non-refundable deposit to the Australian government. The parents become permanent resident when the visa is granted.
